Standard Award Terms and Conditions
Individual awards are based on the application submitted to, and as approved by, the NIH. All awards are subject to the terms and conditions incorporated either directly or by reference in the following:
- Grant Authorities 42 CFR Part 52
- The grant program legislation and program regulation cited in the Notice of Award.
- Conditions on activities and expenditure of funds in other statutory requirements, such as those included in appropriations acts. This also includes any recent legislation noted below.
- CFR Part 200
- 45 CFR Part 75
- National Policy Requirements and all other requirements described in the NIH Grants Policy Statement, including addenda in effect as of the beginning date of the budget period.
- Federal Award Performance Goals: As required by the periodic report in the RPPR or in the final progress report when applicable.
- The Notice of Award including all terms and conditions cited on the document or attachments.

Standard Terms and Conditions made Under COVID Awards
- Reviewers will continue to receive instructions to assume that constraints arising from the COVID-19 pandemic (e.g., lab occupancy restrictions, declines in patient accrual, etc.) will be resolved during the project period and thus should not affect their scores.
- Therefore, NIH grant applications should NOT include contingency or recovery plans for problems resulting from the COVID-19 pandemic. However, applicants may address effects due to the pandemic on productivity or other scoreable issues in their Personal Statement in the NIH Biosketch. Reviewers will be instructed to take these pandemic-related circumstances into account when assessing applicants' productivity and other score-driving factors.

- In accordance with guidance provided by the Department of Health and Human Services, funding prohibitions regarding ACORN and related entities remain in effect pending further litigation as to ACORN's First Amendment and due process claims. This is based on the decision of the U.S. Court of Appeals for the Second Circuit. This guidance now supersedes that provided in the 3/16/2010 OMB Memorandum M-10-12: Memorandum For the Heads of Executive Departments and Agencies. Therefore NIH Guide Notice NOT-OD-10-024 remains in effect.

- Grant payments will be made available through the DHHS Payment Management System (PMS). PMS is administered by the Division of Payment Management, Program Support Center (PSC), DHHS, Office of the Deputy Assistant Secretary, Finance, which will forward instructions for obtaining payments.
