Funding Opportunity Purpose

The purpose of this Funding Opportunity is to solicit applications to generate evidence that could support the approval of label changes to establish more targeted durations of use for certain approved medically important antimicrobial new animal drugs in food animals.

These cooperative agreements are intended to provide publicly available evidence to be used by sponsor(s) of affected approved new animal drugs to fulfill a portion of or all of the requirements for the effectiveness technical section for the approval of future supplemental new animal drug applications. Such supplemental new animal drug applications are intended to:

1) Revise approved dosage regimens to provide for use durations that are more targeted (i.e., are more specifically defined) and,

2) That the revised dosage regimens continue to provide effectiveness that is comparable to the currently approved regimen while reducing the risk of antimicrobial resistance development.

Section I. Funding Opportunity Description

In 2014, the White House announced the National Strategy for Combating Antibiotic-Resistant Bacteria (CARB), underscoring the need to address antimicrobial resistance. The Food and Drug Administration (FDA) has and continues to be integral in these efforts. The development of resistance to antimicrobials of human importance, and the resulting loss of their effectiveness as antimicrobial therapies, poses a serious threat to public and animal health. Because inappropriate antimicrobial drug use can contribute to the emergence of drug-resistant organisms, these important drugs must be used judiciously in both animal and human medicine to slow the development of resistance.

FDA, Center for Veterinary Medicine (CVM) has developed a multipronged strategy designed to limit or reverse resistance arising from the use of antibiotics in food-producing animals, while continuing to ensure the availability of safe and effective antibiotics for use in animals and humans. On April 13, 2012, FDA-CVM published Guidance for Industry (GFI) #209, "The Judicious Use of Medically Important Antimicrobial Drugs in Food-Producing Animals" which outlines FDA's current thinking on strategies for assuring that medically important antimicrobial drugs are used judiciously in food-producing animals in order to help minimize antimicrobial resistance development. GFI #209 outlines two principles for judicious use of these drugs, which are: (1) the use of medically important antimicrobial drugs in food-producing animals should be limited to those uses that are considered necessary for assuring animal health; and (2) the use of medically important antimicrobial drugs in food-producing animals should be limited to those uses that include veterinary oversight or consultation. In December 2013, FDA-CVM published GFI #213, "New Animal Drugs and New Animal Drug Combination Products Administered in or on Medicated Feed or Drinking Water of Food-Producing Animals: Recommendations for Drug Sponsors for Voluntarily Aligning Product Use Conditions with GFI #209" describing the process by which sponsors of these new animal drug applications may voluntarily withdraw approval of non-therapeutic indications (i.e., "production claims") and limit these new animal drugs to prescription or veterinary feed directive use by or on the order of a licensed veterinarian. The voluntary changes recommended in GFI #213 were fully implemented as of January 1, 2017.

While CVM has implemented many important steps to support stewardship of medically important antimicrobials, we believe additional steps are needed. In addition to veterinary oversight, the judicious use of antimicrobials should be linked to a specific etiologic agent and the antimicrobial should be administered for an appropriately targeted period, i.e., have a defined duration of use. On September 14, 2016, FDA posted a Notice in the Federal Register soliciting comments regarding the establishment of appropriately targeted and defined durations of use of medically important antimicrobial drugs administered in the feed or water of food-producing animals for therapeutic purposes. As the Notice explains, although GFI #213 sets out FDA-CVM's expectation that new indications of medically important antimicrobial drugs used in or on feed and water will have defined durations of use, it does not address what to do with respect to some currently approved therapeutics that lack defined durations of use.

Establishing defined durations of use for currently approved therapeutics will support FDA's efforts to foster stewardship of medically important antimicrobial drugs in food-producing animals and help preserve the effectiveness of these antimicrobials in animal and human medicine. A key objective of FDA is to optimize the use of medically important antimicrobials by using a dosage strategy that maximizes drug effectiveness, minimizes target animal toxicity, and has an appropriately targeted and defined duration of use to minimize the development of resistance to antimicrobial drugs of human medical importance.

Problem Statement:

The new animal drug applications with undefined regimens on product labeling were originally approved long ago, and the information used to support approval did not establish a specifically defined duration of use or minimum duration of use when effectiveness was evaluated. As described in 21 CFR 514.4, substantial evidence of effectiveness means evidence consisting of one or more adequate and well-controlled studies demonstrating that the new animal drug is effective under the conditions of use stated in the approved labeling. For therapeutic indications, this substantial evidence should be established at the lowest approved dosage level or inclusion rate (i.e., dose and regimen duration). Among the various new animal drug applications with undefined regimens, there are a number of applications that are approved for identical indications at identical dosage levels or inclusion rates. While a given new animal drug application needs to be supported by substantial evidence of effectiveness, there is the opportunity to use some of the same data (where appropriate) to support the approval of similar applications, or otherwise gain efficiencies by evaluating similar products in the same study. In cases where additional information is needed for a particular drug(s), we expect that the results of studies conducted under this cooperative agreement could be used, at least in part, to help individual sponsors meet the substantial evidence of effectiveness requirements for their drug product(s).

Goal:

The goal of this cooperative agreement program is to generate evidence to satisfy a data gap, lead to the identification of a data gap, or provide all or a portion of the substantial evidence of effectiveness to support the establishment of more appropriately targeted and defined durations of use for one or more of the affected new animal drug applications identified on list above. Applications are intended to provide effectiveness comparable to the currently approved regimen while reducing the risk of antimicrobial resistance development.

Section II. Award Information

Funding Instrument

Cooperative Agreement: A support mechanism used when there will be substantial Federal scientific or programmatic involvement. Substantial involvement means that, after award, FDA scientific or program staff will assist, guide, coordinate, or participate in project activities. It is anticipated that up to 10 awards will be made, not to exceed $500,000 in total costs (direct plus indirect), per award.

Required Registrations

Applicant Organizations

Applicant organizations must complete and maintain the following registrations as described in the SF 424 (R&R) Application Guide to be eligible to apply for or receive an award. All registrations must be completed prior to the application being submitted. Registration can take 6 weeks or more, so applicants should begin the registration process as soon as possible. Failure to complete registrations in advance of a due date is not a valid reason for a late submission.

  • Dun and Bradstreet Universal Numbering System (DUNS) - All registrations require that applicants be issued a DUNS number. After obtaining a DUNS number, applicants can begin both SAM and eRA Commons registrations. The same DUNS number must be used for all registrations, as well as on the grant application.
  • System for Award Management (SAM) Applicants must complete and maintain an active registration, which requires renewal at least annually. The renewal process may require as much time as the initial registration. SAM registration includes the assignment of a Commercial and Government Entity (CAGE) Code for domestic organizations which have not already been assigned a CAGE Code.
  • NATO Commercial and Government Entity (NCAGE) Code Foreign organizations must obtain an NCAGE code (in lieu of a CAGE code) in order to register in SAM.
  • eRA Commons - Applicants must have an active DUNS number to register in eRA Commons. Organizations can register with the eRA Commons as they are working through their SAM or Grants.gov registration, but all registrations must be in place by time of submission. eRA Commons requires organizations to identify at least one Signing Official (SO) and at least one Program Director/Principal Investigator (PD/PI) account in order to submit an application.
  • Grants.gov Applicants must have an active DUNS number and SAM registration in order to complete the Grants.gov registration.

Research Strategy:

Studies conducted under this cooperative agreement should support the approval of label changes to establish more targeted durations of use for certain approved medically important antimicrobial new animal drugs in food-producing animals (see Areas of Interest below)). The evidence produced by the funded study(ies) will be made publicly available and may be used by interested drug sponsor(s) to support, at least in part, the approval of future supplemental new animal drug applications to implement the new conditions of use.

1. Applicant shall, for at least one indication and drug identified under Areas of Interest below, propose and provide evidence to satisfy a data gap, lead to the identification of a data gap, or provide all or a portion of the substantial evidence of effectiveness to support the establishment of an appropriately targeted and defined duration (or duration range) at the currently approved dosage level or inclusion rate (or lowest dosage or inclusion rate if a range is approved).

2. Acceptable approaches include, but are not limited to, traditional clinical studies; model studies; the incorporation of alternative approaches in clinical investigations such as the incorporation of real-world evidence, biomarkers and surrogate endpoints, complex adaptive and other novel investigational designs, or data from foreign countries; or other alternatives to a traditional clinical study such as the use of a systematic review and meta-analysis.

3. Applicant may develop, in collaboration and concurrence with FDA-CVM, a protocol(s) for one or more studies to provide evidence, including but not limited to, substantial evidence of effectiveness of the drug(s) when administered at the proposed duration (or duration range), at the currently approved dosage level or inclusion rate, for each of the new animal drugs approved for the indication. If a duration range and/or dosage/inclusion rate range is appropriate for the indication, the study only needs to evaluate the shortest duration and/or lowest dosage/inclusion rate in the proposed range. FDA-CVM will review and provide comments for revision of the study protocol(s). FDA-CVM's concurrence with the final protocol is required before the study(ies) are started. Study protocols for traditional clinical studies should be consistent with the recommendations in GFI #56, "Protocol Development Guideline for Clinical Effectiveness and Target Animal Safety Trials". Protocols for alternative studies should follow applicable guidelines, if available.

4. Applicants are encouraged to meet with FDA-CVM in person or by teleconference in advance of protocol development to discuss study design proposals and options, particularly if an alternative approach to a clinical study is proposed.

5. Applicant shall conduct the study(ies) in a manner consistent with an appropriate standard of conduct. Studies intended to demonstrate substantial evidence of effectiveness (i.e. adequate and well controlled studies), should be conducted in accordance with GFI #85 (VICH GL9), "Good Clinical Practice" (GCP) and, if applicable, shall cooperate with contemporaneous (live) and data audit inspections of the study conduct and data by FDA's Bioresearch Monitoring program. Among other aspects of adequate and well controlled studies, applicant shall ensure that Type C medicated feeds used as test articles are manufactured according to current Good Manufacturing Practices for medicated feeds and are appropriately assayed for test article concentration and contaminants. Alternative types of studies (e.g. systematic review and meta-analysis or observational study generating real world evidence) should follow the applicable elements of GCP. Other studies should use a standard of conduct appropriate to the study type and evidence generated. The proposed standard of conduct should be described in the protocol.

6. Applicant shall submit the final study report and raw data to FDA-CVM for review, and provide appropriate rights of reference allowing the protocol, report, raw data, and other relevant study documentation to be made available in a Public Master File, such that any drug sponsor may use the data for supplemental approval of their relevant new animal drug application(s).

Areas of Interest:

FDA-CVM is requesting applications to provide data that may be used by multiple drug sponsors of affected new animal drug applications (see list of affected new animal drug applications at [ List of Approved Medically Important Antimicrobial Drugs Administered in the Feed of Food-Producing Animals that Lack a Defined Duration of Use], to support FDA approval of more targeted durations of use which are intended to provide effectiveness comparable to the currently approved regimen while reducing the risk of antimicrobial resistance development.

Resource Sharing Plan: Individuals are required to comply with the instructions for the Resource Sharing Plans as provided in the SF424 (R&R) Application Guide, with the following modification:

  • All applications, regardless of the amount of direct costs requested for any one year, should address a Data Sharing Plan.

Applications that are incomplete, non-compliant and/or nonresponsive will not be reviewed.

Post Submission Materials

Post-submission materials are those submitted after submission of the grant application but prior to objective review. They are not intended to correct oversights or errors discovered after submission of the application. FDA accepts limited information between the time of initial submission of the application and the time of objective review. Applicants must contact the assigned Grants Management Specialist to receive approval, prior to submitting any post submission materials. Acceptance and/or rejection of any post submission materials is at the sole discretion of the FDA. Any inquiries regarding post submission materials should be directed to the assigned Grants Management Specialist.

Section V. Application Review Information
1. Criteria

Only the review criteria described below will be considered in the review process.

Scored Review Criteria

Reviewers will consider each of the review criteria below in the determination of scientific merit.

Significance (30 Points)

Does the project address an important problem or a critical barrier to progress in the field? If the aims of the project are achieved, how will scientific knowledge, technical capability, and/or clinical practice be improved? How will successful completion of the aims change the concepts, methods, technologies, treatments, services, or preventative interventions that drive this field? Is there a strong scientific premise for the project?

Investigator(s) (20 Points)

Are the PD(s)/PI(s), collaborators, and other researchers well suited to the project? If Early Stage Investigators or those in the early stages of independent careers, do they have appropriate experience and training? If established, have they demonstrated an ongoing record of accomplishments that have advanced their field(s)? If the project is collaborative or multi-PD/PI, do the investigators have complementary and integrated expertise; are their leadership approach, governance and organizational structure appropriate for the project?

Approach (30 Points)

Are the overall strategy, methodology, and analyses well-reasoned and appropriate to accomplish the specific aims of the project? Have the investigators presented strategies to ensure a robust and unbiased approach, as appropriate for the work proposed? Are potential problems, alternative strategies, and benchmarks for success presented? If the project is in the early stages of development, will the strategy establish feasibility and will particularly risky aspects be managed? Have the investigators presented adequate plans to address relevant biological variables, such as sex, for studies in vertebrate animals? Does the application address indications that are shared across multiple applications/sponsors?

Environment (20 Points)

Will the scientific environment in which the work will be done contribute to the probability of success? Are the institutional support, equipment and other physical resources available to the investigators adequate for the project proposed? Will the project benefit from unique features of the scientific environment, subject populations, or collaborative arrangements?

Additional Review Considerations

As applicable for the project proposed, reviewers will evaluate the following additional items but will not give separate scores for these items, and should not consider them in providing an overall score.

Vertebrate Animals

The committee will evaluate the involvement of live vertebrate animals as part of the scientific assessment according to the following criteria: (1) description of proposed procedures involving animals, including species, strains, ages, sex, and total number to be used; (2) justifications for the use of animals versus alternative models and for the appropriateness of the species proposed; (3) interventions to minimize discomfort, distress, pain and injury; and (4) justification for euthanasia method if NOT consistent with the AVMA Guidelines for the Euthanasia of Animals. Reviewers will assess the use of chimpanzees as they would any other application proposing the use of vertebrate animals. For additional information on review of the Vertebrate Animals section, please refer to the Worksheet for Review of the Vertebrate Animal Section.

Biohazards

Reviewers will assess whether materials or procedures proposed are potentially hazardous to research personnel and/or the environment, and if needed, determine whether adequate protection is proposed.

Select Agent Research

Reviewers will assess the information provided in this section of the application, including 1) the Select Agent(s) to be used in the proposed research, 2) the registration status of all entities where Select Agent(s) will be used, 3) the procedures that will be used to monitor possession use and transfer of Select Agent(s), and 4) plans for appropriate biosafety, biocontainment, and security of the Select Agent(s).

Resource Sharing Plans

Reviewers will comment on whether the following Resource Sharing Plans, or the rationale for not sharing the following types of resources, are reasonable: (1) Data Sharing Plan; (2) Sharing Model Organisms; and (3) Genomic Data Sharing Plan (GDS).

Authentication of Key Biological and/or Chemical Resources:

For projects involving key biological and/or chemical resources, reviewers will comment on the brief plans proposed for identifying and ensuring the validity of those resources.

Budget and Period of Support

Reviewers will consider whether the budget and the requested period of support are fully justified and reasonable in relation to the proposed research.

2. Review and Selection Process

Applications will be evaluated for scientific and technical merit by (an) appropriate Objective Review Committee, using the stated review criteria.

As part of the objective review, all applications:

  • Will receive a written critique.

Appeals of objective review will not be accepted for applications submitted in response to this FOA.

Applications will compete for available funds with all other recommended applications submitted in response to this FOA. The following will be considered in making funding decisions:

  • Scientific and technical merit of the proposed project as determined by objective review.
  • Availability of funds.
  • Relevance of the proposed project to program priorities.
3. Anticipated Announcement and Award Dates

Successful applicants will be notified of additional information that may be required or other actions leading to an award. The decision not to award a grant, or to award a grant at a particular funding level, is discretionary and is not subject to appeal to any FDA or HHS official or board.

Section VI. Award Administration Information
1. Award Notices

A formal notification in the form of a Notice of Award (NoA) will be provided to the applicant organization for successful applications. The NoA signed by the grants management officer is the authorizing document and will be sent via email to the grantee’s business official.

Awardees must comply with any funding restrictions described in Section IV.5. Funding Restrictions. Selection of an application for award is not an authorization to begin performance. Any costs incurred before receipt of the NoA are at the recipient's risk. These costs may be reimbursed only to the extent considered allowable pre-award costs.

Any application awarded in response to this FOA will be subject to terms and conditions found in the HHS Grants Policy Statement.

2. Administrative and National Policy Requirements

All FDA grant and cooperative agreement awards include the HHS Grants Policy Statement as part of the NoA.

Recipients of federal financial assistance (FFA) from HHS must administer their programs in compliance with federal civil rights law. This means that recipients of HHS funds must ensure equal access to their programs without regard to a person’s race, color, national origin, disability, age and, in some circumstances, sex and religion. This includes ensuring your programs are accessible to persons with limited English proficiency. HHS recognizes that research projects are often limited in scope for many reasons that are nondiscriminatory, such as the principal investigator’s scientific interest, funding limitations, recruitment requirements, and other considerations. Thus, criteria in research protocols that target or exclude certain populations are warranted where nondiscriminatory justifications establish that such criteria are appropriate with respect to the health or safety of the subjects, the scientific study design, or the purpose of the research.

In accordance with the statutory provisions contained in Section 872 of the Duncan Hunter National Defense Authorization Act of Fiscal Year 2009 (Public Law 110-417), FDA awards will be subject to the Federal Awardee Performance and Integrity Information System (FAPIIS) requirements. FAPIIS requires Federal award making officials to review and consider information about an applicant in the designated integrity and performance system (currently FAPIIS) prior to making an award. An applicant, at its option, may review information in the designated integrity and performance systems accessible through FAPIIS and comment on any information about itself that a Federal agency previously entered and is currently in FAPIIS. The Federal awarding agency will consider any comments by the applicant, in addition to other information in FAPIIS, in making a judgement about the applicant’s integrity, business ethics, and record of performance under Federal awards when completing the review of risk posed by applicants as described in 45 CFR Part 75.205 Federal awarding agency review of risk posed by applicants. This provision will apply to all FDA grants and cooperative agreements.

FDA considers the sharing of research resources developed through FDA-sponsored research an important means to enhance the value and further the advancement of research. When research resources have been developed with FDA funds and the associated research findings published, those findings must be made readily available to the scientific community.

Upon acceptance for publication, scientific researchers must submit the author’s final manuscript of the peer-reviewed scientific publication resulting from research supported in whole or in part with FDA funds to the NIH National Library of Medicine's (NLM) PubMed Central (PMC). FDA defines the author's final manuscript as the final version accepted for journal publication, which includes all modifications from the publishing peer review process. The PMC archive is the designated repository for these manuscripts for use by the public, health care providers, educators, scientists, and FDA. Please see the FDA Public Access Policy.

Certificates of Confidentiality 42 U.S.C. 241(d)

Awardees are responsible for complying with all requirements to protect the confidentiality of identifiable, sensitive information that is collected or used in biomedical, behavioral, clinical, or other research (including research on mental health and research on the use and effect of alcohol and other psychoactive drugs) funded wholly or in part by the Federal Government. See 42 U.S.C. 241(d). All research funded by FDA, in whole or in part, that is within the scope of these requirements is deemed to be issued a Certificate of Confidentiality through these Terms and Conditions. Certificates issued in this manner will not be issued as a separate document.

Awardees are expected to ensure that any investigator or institution not funded by FDA who receives a copy of identifiable, sensitive information protected by these requirements, understand they are also subject to the requirements of 42 U.S.C. 241(d). Awardees are also responsible for ensuring that any subrecipient that receives funds to carry out part of the FDA award involving a copy of identifiable, sensitive information protected by these requirements understand they are also subject to subsection 42 U.S.C. 241(d).

Additional terms and conditions regarding FDA regulatory and CVM programmatic requirements may be part of the Notice of Award.

Cooperative Agreement Terms and Conditions of Award

The following special terms of award are in addition to, not in lieu of, otherwise applicable U.S. Office of Management and Budget (OMB) administrative guidelines, U.S. Department of Health and Human Services (DHHS) grant administrative regulations at 45 CFR 75, and other HHS, PHS, and FDA grant administrative policies.

Support will be in the form of a cooperative agreement. Substantive involvement by the awarding agency is inherent in the cooperative agreement award. Accordingly, FDA will have substantial involvement in the program activities of the project funded by the cooperative agreement. Substantive involvement includes bit is not limited to, Evaluation and Performance Measurement Strategy:

Required performance measures for the project period are listed below. Progress will be reported as documents and activities begin and are completed, or at minimum every 6 months during the project period. The purpose of evaluation and performance measurement is to help FDA and Cooperative Agreement awardees:

1) Monitor the extent to which activities planned were successfully completed (i.e., Were activities implemented correctly?);

2) Demonstrate how study methodologies employed contributed towards program goals (i.e., Were outcomes of interest achieved?); and

3) Inform decisions about future data collection efforts and learn from piloted strategies to drive program improvement for more efficient and effective program performance (i.e., What can, and how can things, be improved?)

Below are evaluation questions to be addressed by the FOA during this project period:

1. What are the major activities conducted by awardees that contributed towards achieving program outcomes?

2. What major goals or objectives (i.e., timely justification of proposed durations of use, timely protocol development, timely conduct and completion of studies, timely submission of reports and data) were accomplished by awardees that contributed towards achieving program outcomes?

3. To what extent were awardees proposed studies conducted as planned?

4. To what extent were awardees able to provide substantial evidence of effectiveness for the evaluated area(s) of interest?

All data and results generated by the program activities of the project funded by the cooperative agreement will be made publicly available for use by interested new animal drug sponsors and CVM to the full extent possible in support of approving relevant supplemental new animal drug applications.

3. Reporting

When multiple years are involved, awardees will be required to submit the Research Performance Progress Report (RPPR) annually and financial statements as required in the Notice of Award.

A final RPPR, invention statement, and the expenditure data portion of the Federal Financial Report are required for closeout of an award, as described in the terms and conditions of award and the HHS Grants Policy Statement.

The Federal Funding Accountability and Transparency Act of 2006 (Transparency Act), includes a requirement for awardees of Federal grants to report information about first-tier subawards and executive compensation under Federal assistance awards issued in FY2011 or later. All awardees of applicable FDA grants and cooperative agreements are required to report to the Federal Subaward Reporting System (FSRS) available at www.fsrs.gov on all subawards over $25,000.

In accordance with the regulatory requirements provided at 45 CFR 75.113 and Appendix XII to 45 CFR Part 75, recipients that have currently active Federal grants, cooperative agreements, and procurement contracts from all Federal awarding agencies with a cumulative total value greater than $10,000,000 for any period of time during the period of performance of a Federal award, must report and maintain the currency of information reported in the System for Award Management (SAM) about civil, criminal, and administrative proceedings in connection with the award or performance of a Federal award that reached final disposition within the most recent five-year period. The recipient must also make semiannual disclosures regarding such proceedings. Proceedings information will be made publicly available in the designated integrity and performance system (currently FAPIIS). This is a statutory requirement under section 872 of Public Law 110-417, as amended (41 U.S.C. 2313). As required by section 3010 of Public Law 111-212, all information posted in the designated integrity and performance system on or after April 15, 2011, except past performance reviews required for Federal procurement contracts, will be publicly available. Full reporting requirements and procedures are found in Appendix XII to 45 CFR Part 75 Award Term and Conditions for Recipient Integrity and Performance Matters.
