Publication of Interim Final Rule Adopting OMB's Final Guidance in 2 CFR Part 200 into HHS' Implementing Regulations at 45 CFR Part 75

On December 19, 2014, the Department of Health and Human Services published in the Federal Register, an interim final rule adapting OMB’s final guidance in 2 CFR part 200 with certain amendments, based on existing HHS regulations, to supplement the guidance as needed for the Department. HHS’ amendments are described in the joint preamble, and incorporated into HHS’ implementing regulations at 45 CFR part 75, which are located within the Federal Register document on pages 75889 - 75981. One important note, consistent with current HHS policy, 45 CFR part 75 will apply to all types of organizations, including commercial.
As indicated in the common preamble, HHS is making this rule effective on December 26, 2014, in order to comport with all other Federal agency adoption, and to ensure consistency in all grant making procedures. However, HHS will consider and address comments that are received within 60 days of the date the interim final rule is published in the Federal Register.
NIH will issue separate Guide Notices providing NIH-specific implementation information.
Comments on the HHS interim final rule should be submitted to www.regulation.gov. Please do not submit those to NIH.
