(1) The applicant must hold intellectual property rights (IP) to the investigational agent/device proposed for study.

Modified to read:

Applicants should make note of the following:
(1) The applicants from industry must hold intellectual property (IP) rights to the investigational agent/device proposed for study. However, applicants from non-profits do not need to hold IP rights to the investigational agent/device under study.

All other aspects of the FOA remain unchanged.
